Elahi must take the oath tonight after the SC considers Hamza's election invalid.
After the Supreme
Court ruled that Hamza's election was unconstitutional, Elahi is required
to take the oath 11.30 p.m. tonight.
After hearing the case on pleas pertaining to the
just-concluded voting for the prestigious position, the Supreme Court on
Tuesday proclaimed the deputy speaker's decision regarding the Punjab chief
minister voting worthless.
After some more than 3 hours of waiting, the restrained
judgement was declared by a three-judge panel made up of Presiding Judge Umar
Ata Bandial, Justice Ijazul Ahsan, and Justice Munib Akhtar.
The basic privileges of the public have indeed been gravely
violated as a result of the subversion of the Punjab Province's government in
line with the Legislation. The brief Supreme Court order stated,
"Therefore, the Ruling on 22.07.2022 made by 1st Respondent, Deputy
Speaker, Punjab Assembly, is put down and deemed to be unlawful, lacking
constitutional jurisdiction, and of no legal consequence.
The judges upheld the validity of the 10 votes cast by
PML-Q MPAs in the Chief Minister election that were disregarded by Deputy
Speaker Dost Mohammad Mazari just on basis of a statement from party leader
Chaudhry Shujaat.
In a brief ruling, the Supreme Court directed that the
applicant, Pervaiz Elahi, take office as Punjab's chief minister at 11:30 p.m.
tonight and that the province's current chief minister, Hamza Shehbaz, resign
from his position forthwith.
The Supreme Court also overturned all of Hamza's orders
following the contentious vote for chief minister, during which Hamza received
179 points to Elahi's 186.
The 3 panel further concluded that the deputy speaker
"circumvented the Constitutional Articles" by misinterpreting the
Supreme Court's ruling on Article 63A, which deals with the desertion
provision.
The alliance administration had already asked the top court
to convene a full court to hear Elahi's lawsuit challenging the elections of
the province CM, but the motion had been denied.
Chief Minister Candidate Elahi filed a suit, which was examined by a 3 court chaired by Chief Justice of Pakistan Umar Ata Bandial and including Justices Ijazul Ahsan and Munib Akhtar, And on treatment of PML-Q voting in the Punjab chief executive contest, in defiance of the decision of Punjab Assembly Deputy Speaker Dost Muhammad Mazari.
In his decision, Mazari had disregarded Ten votes from
members of the Pakistan Muslim League-Quaid (PML-Q), based on the SC rule
that votes from parliamentarians who disobeyed leadership directives would not
be taken into account.
